CONSUMER PURCHASES
All purchases or sales or trading conducted by Only Fitness is conducted in “good faith” and by invitation of sale, meaning that Only Fitness offers all product to sell via invitation and may, at any time accept or reject the offer of purchase by the consumer without explanation. Only Fitness endeavours to conduct all of it’s business dealing in compliance to all legislation governing the operations of the business. Only Fitness believes in the value of “fair trade” and understands the importance of this from supplier, distributor and consumer perspective.
All payments and purchases are made in Australian Dollars (AUD) only.
ACCEPTANCE OF USE
Only Fitness is a registered business trading name and listed with IP Australia & Department of Fair Trading. Any use of Only Fitness web site or other channels of sale are conditional to acceptance of the terms and conditions listed by Only Fitness. Only Fitness reserves the right to amend any terms and conditions at any time without notice. CONTRACTUAL ACCEPTANCE
All products contained on www.onlyfitness.com.au are only available to persons who are eligible to make legal contracts in accordance with Australia, state & territory government legislation. A contract is considered as being made once a sale has been paid for by the consumer.
STOCK SUPPLY
At no stage will Only Fitness offer product for sale that has not been purchased by the company for the purpose of selling. If stock of the specified goods are delayed due to reasoning not controlled by Only Fitness, an alternative product with similar value, features and benefits will be offered in it’s place to ensure the customer receives an item of equal comparison or higher value to that advertised. The customer may then chose to accept or decline the offer, and are entitled to full refund of their money should they chose not to accept.
PRICES
All prices advertised on www.onlyfitness.com.au are subject to change without notification. At all times, Only Fitness will endeavour to comply with all legislation governing consumer purchasing to ensure the consumer is treated respectfully and lawfully. We reserve the right to correct pricing errors.
Definitions of our Pricing abbreviations:
RRP = Recommended Retail Price. This is the price that the supplier has provided to Only Fitness as the recommended sell price of the item.
REG or WAS = This is the price that Ony Fitness normally offers customers to purchase the item for. When specials are advertised using the REG price this means that Only Fitness has previously offered the item for sale for at least 2 months at the REG price or has previously sold the item for the REG price.
Only Fitness prices will vary due to sales & promotions of which start and ending dates will be provided in the actual advertisment. Due to room contraints we do not list the price ending date on each individual product on the website however customers are most welcome to call our Head Office to clarify advertisments & advertisment ending dates.
GOODS AND SERVICES ("GST") AND OTHER TAXES
Prices advertised on www.onlyfitness.com.au are inclusive of GST and full prices will be disclosed to the customer prior to their acceptance of purchasing their goods. GST is not negotiable and is taxed at the legislative rate of 10% of sale price. There are no other taxes applicable, however should legislation change to include other applicable taxes, Only Fitness will ensure that at all times it endeavours to comply with legislation governing the business.
DELIVERY
All deliveries are held on behalf of Only Fitness and, once paid for the goods and given to transport, the goods will then become the responsibility of the consumer. Only Fitness will always endeavour to ensure the consumer is assisted where possible should an unfavourable situation occur. Delivery times are indicative only and Only Fitness will not be held responsible for delivery time not being adhered to by the courier companies. Only Fitness will always endeavour to ensure the consumer is assisted where possible should an unfavourable delivery situation occur. Customers are entitled to coordinate their own delivery courier and can notify Only Fitness accordingly. Customers should understand that any delivery issues that arise from their own organised courier discharge Only Fitness from any liability.
REFUNDS & EXCHANGES
Only Fitness will not allow refund or exchanges if the consumer “simply changes their mind” or “makes a wrong selection”. Only Fitness will only offer and exchange, credit or refund if the product has a manufacturers fault and reserves the right to inspect the product prior to providing an exchange, credit or refund.
LIMITATIONS OF LIABILITY
